Why These Cases Deserve a Thoughtful Defense

Domestic violence cases frequently arise from emotional moments between people who share a home, children, or a long history. The first report may not capture the full context, and early decisions can shape the rest of the case.

A thoughtful defense looks closely at the evidence, the circumstances, and the practical consequences for you and your family—including your living arrangements and time with your children.

Who We Help

We represent the person accused. Situations we can discuss with you include:

  • Spouses and Partners Accused After an Argument
  • Accusations Involving Other Family Members
  • People Subject to a Criminal Protective Order
  • Cases Where Children Were Present
  • Cases Where CPS Is Also Involved
  • Questions About Contact and Living Arrangements

What a Consultation Can Cover

A first conversation helps you understand where you stand. Helpful things to bring or be ready to discuss:

Protective Orders, CPS, and the Criminal Case

In a criminal domestic violence case, the court may issue a criminal protective order. That order lists the conditions you must follow and when it expires. Follow it exactly as written. Only the court can change it—an agreement with the other person does not, and the complainant cannot dismiss the charges or waive the order on their own.

When children are in the home, CPS may open its own investigation. That process is separate from the criminal case. Because Sespe Law also handles CPS matters, we can help you understand how each may affect the other and plan your next steps with both in mind.

About Our CPS Representation

Evidence and Document Review

We review police reports, recorded statements, photos, text messages, call logs, and any court paperwork to understand what is alleged and where the account may be incomplete or out of context.

Zachary Tinker then works with you on individualized next steps. Every case is different, and we never promise results—we promise preparation, honesty, and clear communication.

Individualized Next Steps

Read every order you receive carefully, follow every condition exactly, and bring any questions about the order to your attorney rather than to the protected person.

We will explain your options, prepare you for each court date, and keep your long-term goals—work, home, and family—in view throughout the case.

Sespe Law proudly represents clients throughout Ventura County and nearby regions, offering reliable, accessible, and community-focused legal support.

Can the Other Person Drop the Charges?

No. Criminal charges are brought by the prosecution, not by the complainant. The complainant also cannot waive a criminal protective order—only the court can change it.

What Should I Do if I Have a Protective Order Against Me?

Follow it exactly as written, including any no-contact or stay-away conditions, until the court changes it. Talk with an attorney about your circumstances and any concerns about the order.

Will CPS Get Involved?

It can, especially when children live in the home or were present. CPS matters are separate from the criminal case, and we can help you understand both.

Can You Guarantee My Case Will Be Dismissed?

No. No attorney can honestly guarantee an outcome. We review the evidence, explain your options, and pursue the best path for your situation.
